EXECUTIVE ORDER 2000-02T
CREATION OF THE OHIO STATEWIDE INDEPENDENT LIVING COUNCIL
WHEREAS, the Federal Rehabilitation Act of 1973, as amended and reauthorized by the Rehabilitation Act Amendments of 1992 and the Workforce Investment Act of 1998 (Pub.L. 105-220) was enacted to promote independent living, including consumer control, peer support, self-help, self-determination, equal access and individual and system advocacy, to maximize the leadership, empowerment, independence, and productivity of individuals with disabilities, and the integration and full inclusion of individuals into the mainstream of American society; and
WHEREAS, Pub.L. 105-220 requires that each state establish a Statewide Independent Living Council in order to be eligible to receive financial assistance under the Act; and
WHEREAS, Pub.L. 105-220 prohibits the Statewide Independent Living Council from being established as an entity within another state agency; and
NOW, THEREFORE, I Bob Taft, Governor of the State of Ohio, pursuant to Sections 107.17 and 107.18 of the Ohio Revised Code, do hereby Order the creation of the Ohio Statewide Independent Living Council ("SILC"), which shall have the following structure, powers and duties:
There shall be eighteen (18) members of the SILC (eleven (11) voting and seven (7) non-voting) who shall be appointed by and serve at the pleasure of the Governor. The eleven (11) voting members shall include:
At least one director of a center for independent living chosen by the directors of centers for independent living within the state;
Additional members selected from among the following:
Representatives from centers for independent living;
Parents and guardians of individuals with disabilities;
Advocates of and for individuals with disabilities;
Representatives from private business;
Representatives from organizations that provide services for individuals with disabilities; and
Other appropriate individuals.
Generally SILC shall be composed of members who provide statewide representation; who represent a broad range of individuals with disabilities from diverse backgrounds; who are knowledgeable about centers for independent living and independent living services; and a majority of who are persons who are individuals with disabilities and not employed by any State agency or center for independent living.
Ex Officio, non-voting members shall include:
A representative from the Rehabilitation Services Commission;
Six (6) members chosen to represent other State agencies that provide services for individuals with disabilities, including:
The Ohio Developmental Disabilities Planning Council;
The Ohio Department of Aging;
The Ohio Department of Human Services;
The Ohio Department of Mental Retardation and Developmental Disabilities;
The Ohio Department of Health;
The Ohio Department of Transportation.
The length of term on the SILC shall be three (3) years and shall be determined in accordance with the following:
The terms of SILC members appointed pursuant to Executive Order 93-141 shall not be affected by this Executive Order and those members shall serve the complete term for which they were appointed;
No members shall serve more than two (2) consecutive full terms. Members appointed pursuant to Executive Order 93-141 may be reappointed for one term under this order.
A vacancy occurring in the SILC membership shall be filled in the same manner as the original appointment.
A members appointed by the Governor to fill a vacancy occurring prior to the expiration of the term for which a predecessor was appointed shall serve for the remainder of such term;
The Governor shall appoint one (1) member to serve as chairperson from among the voting membership of the SILC. The chairperson shall serve for one (1) year in that capacity unless reappointed by the Governor.
A majority of the voting members of the SILC shall constitute a quorum.
The SILC may, pursuant to R.C. Section 126.31, reimburse members of the SILC for reasonable and necessary expenses of attending SILC meetings, attending other meeting involving SILC interests and in performing SILC duties including child care and personal assistance services), and pursuant to R.C. Section 124.15(J), pay compensation to a SILC member if such member is not employed or must forfeit wages from other employment for each day the member is engaged in performing SILC duties.
The SILC shall furnish a written report of its activities for the preceding calendar year not later than the first day of February of each year to the Governor.
The SILC members shall carry out all other duties and responsibilities as set forth in Pub.L. 105-220.
Effective with this Order, I revoke all Executive Orders which are inconsistent with this order. This Executive Order shall expire on my last day of service as Governor of the State of Ohio, unless rescinded before such date.
